Hindi totoo ang sinabi ng abogadong si Lorenzo “Larry” Gadon, isang loyalista ni Marcos, na si Supreme Court Associate Justice Marvic Leonen ay “walang karanasan” sa paglilitis, at sa gayon ay “hindi kwalipikado” para sa kanyang posisyon.

Sa isang pakikipanayam noong Dis. 8 sa Matters of Fact ng ABS-CBN News Channel (ANC), binigyang-katwiran ni Gadon ang impeachment complaint na isinampa niya laban kay Leonen sa ngalan ng isang kliyente sa House of Representative noong araw ding iyon. Sinabi niya:
“He (Leonen) has no experience in litigation. He has no experience in judiciary (sic). He has no equivalent experience in the government to be appointed as a Supreme Court Associate Justice ([Si Leonen] ay walang karanasan sa paglilitis. Wala siyang karanasan sa judiciary. Wala siyang katumbas na karanasan sa gobyerno para mahirang bilang isang Supreme Court Associate Justice).”

Sinabi ni Gadon — na, noong 2019, ay nasuspinde ang legal practice ng tatlong buwan dahil sa “abusado at walang habas na pananalita” — ang associate justice, na tinawag niyang “walang kakayahan,” ay “ipinasok” sa SC ni dating Pangulong Benigno Aquino III.
ANG KATOTOHANAN
Bago itinalaga sa SC bilang ika-172 associate justice nito noong Nob. 21, 2012, si Leonen ay mayroong higit sa 24 na taong legal experience, na binanggit sa kanyang talambuhay sa 2012 Annual Report ng SC.
Kasama rito ang paglilingkod bilang counsel sa maraming mga landmark case sa Supreme Court, tulad ng Cruz vs. NCIP, et. al, kung saan ipinagtanggol niya ang komunidad ng mga katutubo kaugnay ng konstitusyonalidad ng Indigenous Peoples Rights Act. Ang petisyon, na kinuwestiyon ang ilan sa mga probisyon ng batas, ay ibinasura matapos na muling magtabla sa botong 7-7 ang Supreme Court sa pangalawang deliberasyon nito sa kaso.
Naging kinatawan din si Leonen ng B’laan farming community sa kaso tungkol sa konstitusyonalidad ng Mining Act of 1995. Noong Enero 2004, nagpasya ang Supreme Court na pabor sa mga petitioner, na bumoto upang pawalang bisa ang ilang mga probisyon ng batas. Ngunit noong Disyembre ng taong iyon, “binago ng SC at isinantabi” ang desisyon nito nang pagbigyan nito ang magkakahiwalay na motions for reconsideration na isinampa ng mga respondent sa kaso.
Ang associate justice ay nagbigay din ng legal assistance sa “upland rural poor at indigenous peoples communities” bilang isa sa tatlong tagapagtatag at dating executive director ng Legal Rights and Natural Resources Center – Kasama sa Kalikasan (LRC-KsK), na itinatag noong 1987.
Sa Art. 8, Sec. 7 ng 1987 Constitution ang isang miyembro ng SC ay dapat natural-born citizen, hindi bababa sa 40 taong gulang, at may hindi kukulangin sa 15 taong paglilingkod bilang hukom ng isang lower court o legal practice sa bansa.
Sinabi nito na ang isang miyembro ng judiciary “ay dapat isang taong napatunayan na may kakayahan, integridad, katapatan, at kalayaan.”
Noong unang bahagi ng Nobyembre 2012, si Leonen, na noon ay chief peace negotiator ng gobyerno sa Moro Islamic Liberation Front, ay naiulat na kabilang sa mga “nangungunang” nominado sa short list na isinumite kay Aquino ng Judicial and Bar Council (JBC), ang inatasan na pangasiwaan ang pagpili ng mga nominado para sa mga itatalaga sa judiciary.
Ang JBC — isang walong-miyembrong konseho na may kinatawan mula sa tatlong sangay ng gobyerno, at mga kasapi ng akademya at pribadong sektor, bukod sa iba pa — ay nilikha sa ilalim ng 1987 Constitution “bilang tugon sa sigaw ng publiko na pumapabor na alisin ang politika sa pagtatalaga ng mga hukom.”
Sumusunod ito sa isang pitong-hakbang na vetting process sa pagpili ng mga nominado para sa mga posisyon, kasama na ang mga posisyon ng associate associate ng SC at chief justice. Inaanyayahan nito ang mga miyembro ng publiko na “ipaalam sa Konseho … ang anumang reklamo o mapanirang impormasyon laban sa mga aplikante” para sa posisyon.
Ang proseso ay nagtatapos sa pagpili ng pangulo ng isang itatalaga mula sa short list ng JBC, na karaniwang binubuo ng lima hanggang anim na pangalan.
Bukod sa kanyang legal practice, humawak din si Leonen ng maraming posisyon sa pamamahala sa University of the Philippines (UP), nagsilbing vice president for legal affairs mula 2005 hanggang 2008, at dekano ng UP College of Law mula 2008 hanggang 2011.
Ang impeachment complaint laban sa associate justice ay inihain ng private complainant na si Edwin Cordevilla, ang kliyente ni Gadon, at inendorso sa Kamara ni Ilocos Norte 2nd district Rep. Angelo Barba, pinsan ng natalong 2016 vice presidentiable at dating senador Ferdinand “Bongbong” Marcos Jr. at Sen. Imee Marcos.
Si Leonen ang kasalukuyang justice in charge sa election protest na inihain ni Bongbong Marcos laban kay Vice President Leni Robredo sa SC, na nakaupo bilang Presidential Electoral Tribunal (PET).
Noong Nobyembre, magkahiwalay na nagsampa ng motion ang kampo ni Marcos at ang Office of the Solicitor General (OSG) na humihiling na mag inhibit ang associate justice sa kaso, na nagkakaisang tinanggihan ng PET.
Noong nakaraang buwan, ibinasura rin ng Supreme Court ang hiling ng OSG at ni Gadon para sa mga kopya ng statement of net worth, assets and liabilities (SALN) ni Leonen na gagamitin para sa isang quo warranto petition.
Si Gadon, na tumakbo at natalo sa 2019 senatorial race, ay nakilala sa pagsampa ng impeachment complaint laban kay dating chief justice Maria Lourdes Sereno, na kalaunan ay napatalsik sa pamamagitan ng quo warranto petition noong 2018.
Sa ilalim ng 1987 Constitution, ang mga miyembro ng SC ay maaaring alisin sa puwesto sa pamamagitan ng impeachment dahil sa culpable violation of the constitution, treason, bribery, graft and corruption, betrayal of public trust, o iba pang high crimes. Si Leonen, 57 taong gulang, ay inaasahang mananatili sa SC hanggang Disyembre 2032.
