Nang ipagpatuloy ng ICC ang buong pagsisiyasat nito sa giyera sa droga noong Enero 2023, sinabi nito na ang sariling mga paglilitis sa giyera laban sa droga ng gobyerno ng Pilipinas ay "hindi katumbas ng tunay, kongkreto at progresibong mga hakbang sa pagsisiyasat" na sapat na sasalamin sa pagsusuri ng ICC at magbibigay-katwiran sa pagsususpinde nito.
