FACT CHECK: ICC did NOT reject Duterte drug war case

The clip is an old video from July 2023, when the Appeals Chamber rejected the Philippine government’s appeal to stop the ICC’s investigation into Duterte’s drug war.

A video posted on Facebook (FB) is claiming that the International Criminal Court (ICC) has rejected the case against former president Rodrigo Duterte now detained in The Hague, Netherlands for charges of crimes against humanity. This is false. 

Uploaded on March 25, the 15-second clip shows ICC Judge Marc Perrin de Brichambaut supposedly dismissing Duterte’s case arising from his administration’s bloody war on drugs. The erroneous clip carried text that read:

ICC REJECT FORMER PRESIDENT RODRIGO ROA DUTERTE CASE. Thank you Lord God

The post also bore a caption saying:

SHOUTOUT SA LAHAT NG MAMAHAL KY TATAY RODRIGO ROA DUTERTE WWOOOOOOOO MAKAKA UWI C TATAY D. ANG TAAS ANG NAKAALAM NG LAHAT LORD IKAW NA ANG BAHALA SA KAY TATAY DIGONG WE PRAY FOR YOU TATAY D.”

(Shoutout to all who love Father Rodrigo Roa Duterte wooooo He can come home. The one above knows. Lord we surrender Tatay Digong to you. We are praying for you Tatay D).

The ICC did not reject or dismiss Duterte’s case. 

A reverse image search reveals the clip is from an old video posted on July 18, 2023, when Brichambaut rejected the Philippine government’s appeal to stop the ICC from investigating Duterte’s drug war campaign. 

In the original video, Brichambaut listed the four grounds raised by the Philippines for its appeal submitted in March 2023. However, these were “rejected by the Appeals Chamber by majority,” according to the ICC judge. 

Originally posted by the international court, the video was edited at the 7:29 minute mark to make it appear as if Brichambaut is referring to Duterte’s ongoing case. 

The former Philippine leader remains detained at the ICC Detention Center in Scheveningen after he was arrested and flown to The Hague on March 11. 

He is awaiting the confirmation of charges hearing scheduled for September 23, 2025.

The false video has garnered 2,100,000 views, 23,700 reactions, 5,400 shares, and 1,600 comments as of writing.
