Sinabi ni SAGIP Party-list Rep. Rodante Marcoleta sa pagdinig ng Commission on Appointments (CA) noong Mayo 31 na “sinaway” ng International Court of Justice (ICJ) ang retiradong Supreme Court (SC) associate justice na si Antonio Carpio tungkol sa isang reklamo sa pagkakaroon ng mga barkong Tsino sa loob ng teritoryo ng Pilipinas. Hindi ito totoo.
Carpio never filed a petition in the ICJ. The Netherlands-based court has no mandate to handle complaints by individuals or private entities other than the cases filed by member states or organs and specialized agencies of the United Nations (UN) such as the World Health Organization.
Hindi kailanman naghain ng petisyon si Carpio sa ICJ. Ang korte na nakabase sa Netherlands ay walang mandato na pangasiwaan ang mga reklamo ng mga indibidwal o pribadong entity maliban sa mga kasong isinampa ng mga miyembrong estado o organs at mga espesyal na ahensya ng United Nations (UN) gaya ng World Health Organization.
Ginawa ni Marcoleta ang pahayag nang tanungin niya noon si Foreign Affairs undersecretary Carlos Sorreta kung kailangang iayon ang 1987 Constitution at iba pang domestic laws sa public international law, kabilang ang UN Convention on the Law of the Sea (UNCLOS).
Sumagot si Sorreta – ngayon ay permanenteng kinatawan ng bansa sa UN sa Geneva – ng pag-sangayon at binanggit ang desisyon ng SC noong 2011 sa kasong Magallona vs. Executive Secretary na isinulat ni Carpio.

Noong Setyembre 2020, inihayag ng yumaong Foreign Affairs secretary na si Albert Del Rosario na magsusumite sila ng bagong ebidensiya sa ICC, kung saan si Carpio ang nagsisilbing abogado nila, upang patunayan ang nangyayaring mga sinasabing krimen sa teritoryo ng Pilipinas at hindi lamang sa loob ng exclusive economic zone nito. Binanggit niya ang iligal na reclamation at artificial island-building ng China sa Subi Reef, na sinasabing nasa loob ito ng territorial sea ng Pag-asa Island sa Spratlys.
Sa isang pahayag noong Hunyo 6 sa VERA Files Fact Check, sinabi ni Carpio, “Pagkatapos kong magretiro sa SC, pumasok ako bilang co-counsel ngunit walang mga pleading na isinampa pagkatapos noon.”
